There\u2019s a new compliance cop in town \u2013 and it\u2019s not just for health care, financial or credit card information \u2013 it\u2019s for any company that holds personally identifiable information (PII) on their servers.<\/p>\n<p>On Monday, a <a href=\"https:\/\/arstechnica.com\/tech-policy\/2015\/08\/ftc-can-sue-companies-with-poor-information-security-appeals-court-says\/\">Federal Appeals Court<\/a> ruled the Federal Trade Commission (FTC) has the power to take action against companies that employ poor IT security practices. Over a year ago, <a href=\"https:\/\/otavawebsite.wpengine.com\/blog\/is-the-ftc-enforcing-better-cybersecurity-for-data-protection-in-non-regulated-industries\/\">we talked about the US District Court ruling<\/a> which has been upheld by the Federal Appeals Court.<\/p>\n<p><a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2015\/08\/statement-ftc-chairwoman-edith-ramirez-appellate-ruling-wyndham\">In a statement, the FTC\u2019s Chairwoman Edith Ramirez<\/a> said \u201cToday\u2019s Third Circuit Court of Appeals decision reaffirms the FTC\u2019s authority to hold companies accountable for failing to safeguard consumer data. It is not only appropriate, but critical, that the FTC has the ability to take action on behalf of consumers when companies fail to take reasonable steps to secure sensitive consumer information.\u201d<\/p>\n<p>The FTC says that the decision upholds the commission\u2019s authority to bring data security cases under the provision of Section 5 of the FTC Act that outlaws unfair acts or practices in or affecting commerce.<\/p>\n<p>So what does this mean to CIO\u2019s? If you hold PII on your servers, you are now accountable to the FTC. Unlike HIPAA regulations where the fines are large, but defined, the FTC can sue anyone under this new ruling without a cap on damages if they feel you are not taking reasonable steps to secure sensitive consumer information.<\/p>\n<p>How do you define reasonable?
